All members must sign and return this agreement each year

  3. Leave the signed agreement in the Treasurer's folder at the boathouse.

Indemnification and Release Agreement

  1. I acknowledge, agree and represent that I understand the nature of rowing activities, both on the water and land-based, and that I am qualified in good health, and in proper physical condition to participate in such activity.
  2. I fully understand that (a) rowing activities involve risks and dangers of serious bodily injury, including but not limited to, disability, paralysis and death, (b) these risks and dangers may be caused by my own actions, or inactions, the actions or inactions of others participating in the activity, the condition in which the activity takes place, or the negligence of others and (c) there may be other risks and social and economic losses either not known to me or not readily foreseeable at this time and I fully accept and assume all such risks and all responsibility for losses, costs, and damages I incur as a result of my participation in the rowing activity.
  3. I agree to inspect all equipment before using it and to take full responsibility for assuring that the equipment is in good working order and safe to use. I further understand that I am responsible for damage to club equipment not otherwise caused by normal wear and tear. I certify that I have read the Riverside Boat Club ("RBC") Guide and agree to abide by the rules and policies stated therein.
  4. On behalf of myself, my personal representatives, assigns, heirs and next of kin I hereby release, discharge and covenant not to sue RBC, its directors, trustees, officers, members, volunteers, and employees (the "Releasees"), from all liability, claims, losses or damages on my account arising out of rowing activities at or associated with RBC, unless caused by the sole negligence of the Releasees. I further agree that if, despite this release and indemnity agreement, I or anyone on my behalf makes a claim against any of the Releasees, I will indemnify, defend and hold harmless each of the Releasees from any litigation expense, attorney fees, loss, liability, damage or costs which also may incur as a result of such claim.
  5. I have read this agreement, fully understand its terms, understand that I have given up substantial rights by signing it and have signed it freely without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by the law of the Commonwealth of Massachusetts and agree that if any portion of this agreement is held invalid by a court of competent jurisdiction, the balance notwithstanding shall continue in full force and effect.
